1. Introduction

4. Legal Basis for Processing

5. Data Sharing and Disclosure

ph47 does not sell your personal data to third parties. ph47 may share your personal data with third parties only in the following circumstances:

Service Providers: ph47 engages third-party service providers for payment processing (GCash, PayMaya, BPI, BDO, Metrobank), identity verification, fraud detection, customer support software, and cloud hosting. These providers are bound by data processing agreements that require them to process your data only in accordance with ph47's instructions and this Policy.

Regulatory and Law Enforcement Authorities: ph47 may disclose personal data to the National Privacy Commission, PAGCOR, the Anti-Money Laundering Council (AMLC), law enforcement agencies, or courts of competent jurisdiction where required by applicable law, court order, or regulatory directive. ph47 will notify you of such disclosure to the extent permitted by law.

Business Transfers: In the event of a merger, acquisition, reorganization, or sale of all or substantially all of ph47's assets, your personal data may be transferred to the acquiring entity, subject to the same privacy protections as described in this Policy. ph47 will notify you in advance of any such transfer.

Consent-Based Sharing: ph47 will share your personal data with third parties for other purposes only with your explicit, informed consent.

6. Data Retention

ph47 retains your personal data for as long as your account remains active and for such additional periods as are required by applicable law or regulation. For anti-money laundering compliance purposes, transaction records and identity verification documents are retained for a minimum of five (5) years following the date of the relevant transaction or the closure of your account, whichever is later. Usage and technical data are retained for shorter periods in accordance with operational necessity and applicable guidelines.

Upon expiration of the applicable retention period, ph47 will securely delete or anonymize your personal data such that it can no longer be attributed to you as an identified or identifiable individual.

7. Security Measures

ph47 implements appropriate technical and organizational measures to protect your personal data against unauthorized access, disclosure, alteration, loss, or destruction. These measures include: HTTPS encryption for all data transmissions; salted cryptographic hashing for password storage; OTP-based two-factor authentication for account access; role-based access controls limiting internal access to personal data on a need-to-know basis; regular security assessments and vulnerability testing; and incident response procedures for detecting and managing data security events.

Despite these measures, no data transmission over the internet or electronic storage system is completely secure. ph47 cannot guarantee absolute security and will not be liable for unauthorized access that occurs despite its reasonable security measures. You are responsible for maintaining the confidentiality of your account credentials.

ph47 uses cookies and similar tracking technologies to support platform functionality, maintain login sessions, detect fraud, and analyze platform usage. The following categories of cookies are used:

10. Children's and Minors' Privacy

The ph47 platform is strictly for persons aged 21 years and above. ph47 does not knowingly collect personal data from persons under 21 years of age. If ph47 discovers that personal data has been collected from a person under 21 years of age, ph47 will immediately close the associated account, delete the relevant personal data to the extent permitted by applicable law, and void any transactions associated with that account. If you have reason to believe that a person under 21 years of age has registered a ph47 account, please contact ph47 support immediately.

11. Changes to This Policy

ph47 may update this Privacy Policy from time to time to reflect changes in its data practices, applicable law, or regulatory requirements. Material changes will be communicated to Members via platform notification or email to their registered address, with a minimum of seven (7) days' notice before the updated Policy takes effect. The date of the most recent update is indicated at the top of this Policy. Continued use of the ph47 platform after the effective date of any updated Policy constitutes your acceptance of the revised terms.
